The facts
Watertight Roofing, Inc. was hired to re-roof a commercial office building. Shortly after completion, the building owner experienced water intrusion in the building's attic following moderate afternoon rain. Since the attic served as a primary storage space, most of its contents were ruined due to the intrusion. Additionally, the ceiling below the attic showed water spots.
The result
Investigation revealed that Watertight Roofing, Inc. had failed to adequately secure flashing around an attic fan during installation. This allowed rainwater into the attic, causing damage to the attic contents and water spots on the ceiling below.
It was determined that this was a case of faulty workmanship on the side of the roofing contractor. Watertight Roofing, Inc. improperly installed the flashing resulting in water intrusion. The building owner filed suit against the contractor, alleging that the contractor failed to properly install the flashing.
Watertight Roofing, Inc.'s general liability policy did not provide coverage due to a faulty workmanship exclusion, however the Victor's General & Artisan Contractors E&O policy, written through CNA Insurance, responded to the suit and covered the claim.
